Description

At the time of inspection, the rear escape route serving the premises was obstructed by bins belonging to a neighbouring unit. This is one of two means of escape from the first-floor office, so persistent obstruction could prevent safe evacuation. A compromised escape route creates direct liability for the responsible person.

The situation

A converted 1600s mews, now communal housing. A listed building with all the quirks of its age.

What we did

Listed status meant off-the-shelf recommendations didn't apply. We assessed what was genuinely reasonable given what could and couldn't be altered, rather than demanding wholesale changes the building couldn't take.

Deficiencies that could have implicated life, and therefore triggered enforcement action, are now resolved. They've moved toward compliance, the responsible person has a defensible position, and they're no longer exposed with their property insurer.

  • It applies where the report is found not to be "suitable and sufficient" under Article 9 of the Regulatory Reform (Fire Safety) Order 2005, in respect of the information made available to us at the time of assessment.
  • It does not apply to whether recommendations, findings, or the action plan in the report have been implemented. Carrying out (or choosing not to carry out) any remedial works is the duty of the responsible person, not RobinsFire.
  • We're not liable for matters that weren't disclosed, weren't accessible during the visit, or that materially changed after the assessment date (e.g. a new use, alteration, occupancy change, or undisclosed use of part of the building).
  • We're not liable for the actions or omissions of third parties, contractors, tenants, other occupiers, or duty-holders responsible for managing fire safety on a day-to-day basis.
  • Claims must be raised within 12 months of report delivery, with a copy of the enforcement / insurer correspondence that triggered the review.
  • Refund is limited to the original fee paid for the assessment. The guarantee does not extend to consequential losses, remedial works, or third-party costs, those are matters for our £5M professional indemnity cover.
